Terms and Conditions

Host: Nicole Heunemann, Weidenweg 29, 04425 Taucha These travel terms and notices govern the legal relationship between you and us. They apply in addition to §§ 651a et seq. of the German Civil Code (BGB).

1. Conclusion of the Travel Contract

Your booking request constitutes a binding offer to conclude a travel contract on the basis of these travel and payment terms. The booking can be made in writing (by post or email), verbally, or by telephone. The person making the booking books not only on their own behalf but also on behalf of all participants listed in the booking. If the person making the booking expressly declares that they accept responsibility for the contractual obligations of all registered persons, they are liable for these obligations alongside the other participants they have registered. The travel contract comes into effect once the booking is accepted by Nicole Heunemann, Weidenweg 29, 04425 Taucha. You will receive written confirmation from us, which we will send to your email address or postal address as soon as possible. If the content of the booking confirmation differs from that of your booking request, we will expressly point this out in the confirmation. We are bound by this new offer for 10 days. The contract is concluded on the basis of this new offer if you declare your acceptance to us within 10 days. If you do not, no contract is concluded.

2. Arrival / Departure

Check-in is possible between 4:00 p.m. and 10:00 p.m. You must inform us of any delayed arrival no later than the agreed arrival time. If you fail to notify us, we are entitled to let the accommodation to someone else. Check-out must take place by 10:00 a.m. at the latest on the day of departure. Any separate arrangements remain unaffected. If the accommodation is not vacated on time, we may charge an appropriate additional fee. We reserve the right to claim further damages. Other arrival and departure times can be arranged individually with the Host. As a rule, no (pro-rata) refund of the rent is granted in the event of early departure.

3. Special Requests and Ancillary Agreements

Special requests and ancillary agreements are possible in principle. They require written confirmation by the Host. Bringing pets is generally not permitted. If you wish to bring a pet, this is only possible with the Host’s prior express written consent.

4. Payment

Payment for the services provided by the Host, including all ancillary and additional costs, is due within 14 days of the invoice date. If the arrival date is less than 14 days away, payment is due by the arrival date, unless a different arrangement has been made. Payment is made by direct bank transfer to the Host’s bank account or by credit card, PayPal, or other payment systems offered by the Host directly or indirectly via external booking portals. If the payment deadlines are not met, the Host may withdraw from the contract. Non-payment is deemed a cancellation and entitles the Host to re-let the property. No additional charges are levied for water, parking, waste, or energy. A visitor’s tax (Kurtaxe) is charged for issuing the guest cards. To determine the amount of the Kurtaxe, the Host or a person appointed by them may request further details during the booking process. The amount of the Kurtaxe and the payment details will then be communicated to you.

5. Cancellation

You may withdraw from the contract at any time. The cancellation must be made in writing. In the event of cancellation, you are obliged to compensate us for the damages incurred, unless otherwise agreed in the individual offer at the time of booking:
  • For bookings with an arrival date from 16 March to 30 November: up to the 5th day before the start of the rental – no cancellation fee
  • For bookings with an arrival date from 16 March to 30 November: from the 4th day up to the day before the start of the rental – 80% of the total price
  • For bookings with an arrival date from 1 December to 15 March: up to the 28th day before the start of the rental – 50% of the total price
  • For bookings with an arrival date from 1 December to 15 March: up to the 7th day before the start of the rental – 80% of the total price
  • For bookings with an arrival date from 1 December to 15 March: from the 6th day before the start of the rental – 100% of the total price
The relevant date is in each case the date on which we receive your notice of cancellation. Amounts already paid will be offset. You may nominate a replacement person to take over your contract under the stated conditions; written notification is sufficient. From the arrival date onward, the full rental price is payable.

6. Obligations of the Renting Party

The renting party undertakes to treat the rented property (holiday apartment, furnishings, and outdoor areas) with care. If any damage to the holiday property and/or its furnishings occurs during the rental period, the renting party is obliged to report this to the Host without delay. Any defects or damage noticed on arrival that were not reported in advance must be reported to the Host immediately; otherwise the renting party is liable for such damage. A reasonable period must be granted to remedy damage and defects. Claims based on complaints that are not reported on site without delay are excluded. Complaints that reach the Host only at the end of the stay or after the holiday property has been vacated are likewise excluded from compensation. In the event of any disruption to services, the renting party is obliged to do everything reasonable within the scope of their legal obligations to help remedy the disruption and to keep any resulting damage to a minimum. On the day of departure, the renting party must remove personal belongings, dispose of household waste in the designated containers, and store dishes clean and washed in the kitchen cupboards.

7. Data Protection

The renting party agrees that data relating to them which is necessary for the performance of the contract concluded with them may be stored, amended, and/or deleted. All personal data is treated in strict confidence.

8. Smoking

Smoking is not permitted anywhere in the holiday apartment or in the hallway. In the event of non-compliance, we reserve the right to claim damages of up to €350.

9. Final Cleaning / Return of the Holiday Apartment

The final cleaning is carried out by the Host; unless otherwise agreed, the cost of this is included in the rental price. Should waste and soiling left after vacating the holiday apartment exceed the usual extent, the Host reserves the right to charge the renting party for the additional costs incurred.

10. Liability

The listing has been prepared to the best of our knowledge. We accept no liability for any impairment of the rental property caused by force majeure, by locally common power and water outages, or by severe weather. Likewise, no liability is accepted for unforeseeable or unavoidable circumstances such as official orders, sudden construction work, or disruptions caused by natural or local conditions. However, the Host is happy to help resolve such problems wherever possible. The Host accepts no liability for the use of the play and sports equipment provided. The renting party travels to and from the property at their own responsibility and risk. The Host is not liable for personal belongings in the event of theft or fire. The renting party is fully liable for any wilful destruction or damage.

11. Final Provisions

Photos and text on the website and in the flyer are intended to provide a realistic description. A 100% match with the rental property cannot be guaranteed. The Host reserves the right to make changes to the furnishings (e.g. furniture), provided they are of equivalent value. Should one or more provisions of these terms and conditions be or become invalid, this does not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid one that comes closest to the economic and legal intent of the contracting parties. German law applies. The place of jurisdiction and performance is the Host’s place of residence.
